REVIEW OF CASUAL EMPLOYMENT TERMS IN MOST AWARDS
The Fair Work Commission (FWC) has completed the task of inserting Casual Terms, consistent with the Omnibus Legislation, into 151 Modern Awards.
EXAMPLES OF HOW AWARDS HAVE CHANGED:
– adding the new definition of Casual Employment
– referring to the new Casual Conversion Provisions in the Fair Work Act, if the current Award Clauses aren’t as beneficial or operate differently
– removing any requirements for Employers to specify hours or likely hours for Casual Employees.
We recommend Employers check Amendments to the Casual Clause in their relevant Modern Award. Employers need to ensure they understand the changes and update their processes.
CASUAL EMPLOYMENT INFORMATION STATEMENT (CEIS)
Please find linked the latest version of the Casual Employment Information Statement (CEIS) for your attention.
We recommend Employers carefully read this Statement to ensure they understand the content.
Employers must give every new Casual Employee a CEIS before, or as soon as possible after, they start their new job.
PROVIDING EMPLOYEES WITH THE CEIS
Employers can give Casual Employees the CEIS:
– in person
– by mail
– by email
– by emailing a link to the copy of the CEIS available on the Employer’s intranet
– by fax
– by another method
Employers must give Casual Employees the current version of the CEIS when they issue it.
Please note that Employers must also provide the Fair Work-Information Statement (FWIS) to new Casual Employees.
We recommend Employers carefully read the CEIS, noting:
SMALL BUSINESSES
Employers of small businesses (fewer than 15 Employees) do not have to offer Employees Casual Conversion, but an Employee can make a request if they meet the requirements (refer the table in the attached CEIS).
